Estate Litigation and Wills Variation Actions
Trustees and executors of wills retain GSW to resist claims
by disappointed beneficiaries. We also assist claimants who have been
disinherited.
Examples of our work in this area include:
- pursuing the redistribution of gifts made pursuant to
the deceased's will
- advancing claims under the equitable relief jurisdiction
of the court where the deceased has not left a will
- negotiating and crafting resolutions to solve the problems
created by unequal gifting amongst family members
- appointing a committee where the individual is incompetent
by reason of mental or physical infirmity
- bringing proceedings to interpret a trust agreement
or a will
- seeking a determination of the capacity of the testator
to make a will
